These “Terms of Use” apply to Embodied Woman, LLC and https://embodiedwoman.com (hereinafter referred to as “the School”) and all content associated with the School. Content associated with the School includes any and all written, recorded, or downloaded maternal that is purchased, viewed, or otherwise offered by the School including, but not limited to, courses, blog posts, newsletters, emails, guides, worksheets, workbooks, webinars, coaching services, consultations, digital downloads, podcasts episodes, social media posts, and website content.

These “Terms of Use” were written to clearly explain the limitations, terms, and conditions associated with viewing, accessing, purchasing, downloading or otherwise using any course, program, service, or product offered by the School. Please read these “Terms of Use” carefully and in their entirety prior to engaging with the School.

Accessing the School and it’s content in any capacity indicates your understanding and consent of these “Terms of Use”. By accessing this School and it’s content, you are voluntarily agreeing to be bound by these Terms, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws.

You must be 18 years old to consent to these “Terms of Use”. If you are under the age of 18 and/or do not agree with the terms and conditions described in these “Terms of Use” you are prohibited from using or accessing this site and any content associated with this School.

2. Copyright

The materials contained in this School are protected by applicable copyright and trademark law. No content associated with the School may be reproduced, modified, copied, or redistributed in any form without permission except as permitted by U.S. copyright law. Any violations of these terms will legally pursued by the fullest extent of the law.

3. Use License

Permission is granted to temporarily download one copy of any downloadable materials on the School’s website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
modify, copy, or redistribute the materials in any form;
use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
attempt to decompile or reverse engineer any software contained on the School’s web site;
remove any copyright or other proprietary notations from the materials; or

The school is not liable for damages of any kind related to your use of the School or any information contained or discussed therein. By accessing the School you agree that you do so at your own risk, after making an independent assessment of risk.

Any resemblance to persons or other entities is purely coincidental. No identification with actual persons (living or deceased) is intended or should be inferred.

5. Limitations

In no event shall the School be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on the School’s website, even if the School or an authorized correspondent of the School has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

6. Payments

In setting up payments for content purchased through the School you may be instructed to agree to terms of service offered by Teachable and/or Stripe.

Stripe is an independent party from the School and the School is not responsible for the contents of their terms of service. Should Stripe's terms of service differ from these Terms, such differences shall not modify these Terms in any manner.

One Time Payments

If you elect to purchase content on a one-time purchase basis, you can fully access your content by paying a singular amount at the time of purchase.

Payment Plans

If you elect to purchase content using a payment plan, you will pay a set amount of monthly fees as dictated through your plan. By electing to purchase content through a payment plan, you are providing consent to your elected form of payment to be charged one time each month for the time frame selected upon checkout until your total payment has been completed. The school will not seek any additional authorization prior to charging payment for each installment of your payment plan.

You are unable to cancel your enrollment in the School until you have fully paid for your purchase. By electing a payment plan you agree that all monthly payments are owed in full. No refund requests or stop payment requests will be considered or accepted by the School.

Should your authorized payment fail for a monthly payment, the payment will be re-tried an additional three times (for a total of four charge attempts) on the 3rd, 7th, and 14th day after the first attempt. If you do not provide updated payment information within this time for a successful payment, then you will be automatically unenrolled from the School and prevented from accessing any content.

Chargebacks

Should you initiate a chargeback through the School, you will be automatically unenrolled and/or unable to access the content you originally purchased. The School reserves the right to dispute any chargebacks initiated.

Limited product access duration

The School may set a duration of time in which you have access to any content you purchase through the School. These limits in product access duration will be clarified prior to purchase.

Negative Balance Collections

Should you not authorize payment or are otherwise not current on your payments to the School, your access to the school or content may be restricted until your account becomes current and paid in full. The School reserves the right to pursue fees owed using collection methods which may include, but are not limited to, charging other payment methods on file with the School and/or retaining collection agencies or legal counsel.

Refund Policy

Courses purchased through the School are entitled to a fourteen (14) day full refund from the date of purchase. No refunds are provided for digital downloads or coaching services. A set of courses and coaching offerings as a bundled package is NOT eligible for a refund. A set of digital downloads with courses or coaching offerings as a bundled package is NOT eligible for a refund.

7. Revisions and Errata

The materials appearing on the School’s website may include technical, typographical, or photographic errors. The School does not warrant that any of the materials on its web site are accurate, complete, or current. The School may make changes to the materials contained on its web site at any time without notice. The School does not, however, make any commitment to update the materials.

8. Links and Endorsements

The School has not reviewed all of the sites, products, or individuals linked to, or mentioned on, its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by the School of the site. Use of any such linked website or product is at the user's own risk.

9. Site Terms of Use Modifications

The School may revise these Terms of Use for its website and all associated content at any time without notice. All changes are effective immediately when posted and apply to all uses of the School thereafter. You may access updated Terms of Use on the School’s website. By using this website you are agreeing to be bound by the then current version of these Terms of Use.

10. Governing Law

Any claim relating to the School’s website shall be governed by the laws of the School Owner’s home jurisdiction without regard to its conflict of law provisions.
